Falana Demands Completion dates for Warri, Kaduna, and Port-Harcourt Refineries

Senior Advocate of Nigeria, Femi Falana, has issued letters to two contractors, Marie Tecnimont S.P.A and Saipem Contracting Nigeria Ltd, seeking clarity on the completion dates for the rehabilitation of the Port Harcourt, Warri, and Kaduna refineries.
The letters, dated September 17, were addressed to the managing directors of both companies, which were awarded contracts for the projects.
Falana stated that the Federal Government had awarded Marie Tecnimont S.P.A the contract to rehabilitate the Port Harcourt refineries at a cost of $1.5 billion.
Similarly, Saipem was contracted to handle the Warri and Kaduna refineries for the same amount. The contracts, awarded in April 2021, were structured to be completed in three phases over 18, 24, and 44 months.
The senior advocate submitted the requests under the Freedom of Information Act, giving the contractors a seven-day window to respond.
He argued that although the companies are private entities, they are still accountable under the FOI Act because of the significant public funds utilized for the projects.
Referring to a legal precedent, Falana pointed to the case of Coscharis Motors Ltd. v. The E.I.E Project Ltd/GTE & Anor., where the Court of Appeal ruled that “a private body or company would be as accountable as a public institution or body under the Act if it has provided any form of public services, or performed any form of public function or utilized public funds.”
He urged the contractors to comply with his request, warning that failure to do so would result in legal action.

Meanwhile, Human rights lawyer Femi Falana, SAN, has stated that it is illegal for the Nigerian National Petroleum Company Limited, NNPCL, to fix the price of petrol for the Dangote Refinery after deregulation.
